Emergency Regulations for California’s Cannabis Industry Approved

California’s Office of Administrative Law (OAL) has approved the latest emergency regulations from the Department of Cannabis Control (DCC). These emergency regulations went into effect immediately and govern all cannabis licenses (regardless of the licensee type) and commercial cannabis activity in the State of California.

It should be noted that the approved emergency regulation text does not contain all of the regulations that are in effect, but rather only the regulations that the DCC changed via this latest rulemaking action. Other sections remain unchanged from when the DCC moved all of the cannabis regulations into Title 4, Division 19 of the Cal. Code of Regs. earlier this year via what’s known as a “Section 100” change; those sections can be found in the “Section 100” packet that was issued in July 2021 (but be careful as many of the sections in this packet were modified). This explains the “gaps” in the new emergency regulations, which we’ve been receiving questions about.
